Benedict's Law

Benedict's Law introduces a mandatory national framework for allergy safety in all English schools. Named in memory of five-year-old Benedict Blythe, it shifts allergy management from voluntary guidance to legal requirement.

Why this law matters

On 1 December 2021, five-year-old Benedict Blythe suffered a fatal anaphylactic reaction at his primary school in Lincolnshire. The subsequent inquest revealed that the school lacked a formal allergy policy, staff had not received adequate allergy awareness training, and early warning symptoms were not recognised quickly enough.

Benedict's Law, brought as an amendment to the Children's Wellbeing and Schools Bill, ensures no school is left without clear procedures, trained staff, and proper emergency equipment. Approximately 680,000 pupils in England live with allergies — that is an average of one to two children in every classroom.

The four pillars of Benedict's Law

Schools must meet all four requirements by September 2026.

Whole-School Allergy Policies

Schools must develop, adopt, and publish comprehensive allergy safety policies. These must be reviewed annually and following any serious incident or near miss, overseen by a named senior leader and governor.

Mandatory Staff Training

All staff members must receive allergy awareness training covering recognition of anaphylaxis symptoms, proper use of adrenaline auto-injectors, and the school’s specific allergy policy. Training must be provided as soon as staff join the school.

Emergency Adrenaline Auto-Injectors

Schools must hold in-date spare adrenaline auto-injectors (AAIs) on site as mandatory emergency equipment. These must be readily accessible and kept separately from individual pupil medications.

Individual Healthcare Plans

Each pupil with a known allergy must have a personalised Individual Healthcare Plan (IHP) developed collaboratively with families and healthcare providers, reviewed at least annually.
